These Terms of Service (the “Terms”) govern your access to and use of DriveAwareness.org (the “Site”), a project focused on documentary‑journalistic stories with receipts. The Site is operated by DriveAwareness.org Inc (“DriveAwareness,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1) Who we are
DriveAwareness is a public‑interest project. We accept public submissions, verify evidence, and publish stories, timelines, and analysis. Contact: info@driveawareness.org.
2) Not legal advice; editorial discretion
We publish journalism and civic tooling. Nothing on the Site is legal, medical, or financial advice. Publication decisions are at our sole editorial discretion. We may edit for length, clarity, or safety; we label allegations and corrections.
3) Your account and access
The Site may offer features with or without accounts. You must be at least 13 years old (or the minimum age required by your jurisdiction). You are responsible for your activity, and for keeping any credentials secure.
4) Acceptable use
You agree not to: (a) upload unlawful, defamatory, or doxxing content; (b) infringe others’ rights; (c) attempt to breach security; (d) use the Site to harass or intimidate; (e) spam or interfere with normal operation. We may suspend or remove content or access for violations.
5) User submissions and license
- You retain ownership of your Submissions.
- You grant DriveAwareness a non‑exclusive, worldwide, royalty‑free, sublicensable license to host, store, cache, reproduce, publish, display, perform, adapt (for formatting/redaction), translate, create limited editorial derivatives, and distribute your Submissions in connection with the Site and our journalistic work, including promotion of that work.
- You warrant that you have the rights to submit the content and that it does not violate law or third‑party rights. You agree to remove or identify sensitive personal data before uploading.
- You consent to our Evidence Handling Policy and Privacy Policy.
6) Takedowns, disputes, and corrections
We honor valid DMCA notices and counter‑notices. See /legal/dmca. We also offer a Corrections & Right‑of‑Reply process at /legal/corrections.
7) Third‑party services
We use third‑party services (e.g., hosting, storage, analytics, email). Their terms and privacy policies apply to your use of features powered by them.
8) Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR‑FREE OR UNINTERRUPTED.
9) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVEAWARENESS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SITE OR CONTENT.
10) Indemnity
You agree to indemnify and hold harmless DriveAwareness from claims arising out of your Submissions or your violation of these Terms or applicable law.
11) Dispute resolution and governing law
These Terms are governed by the laws of Utah, without regard to conflict‑of‑laws rules. Venue and jurisdiction lie in the courts of Salt Lake City. Where permitted by law, you waive class actions and agree to bring claims individually. Nothing herein limits your rights under mandatory consumer laws.
12) Changes
We may update these Terms. If we make material changes, we will provide notice (e.g., via the Site). Continued use after changes means you accept the updated Terms.
